Final Approval Order - This is the order granting final approval to the settlement, making it effective. Under the terms of the settlement the Pension Plan will be amended such that class members will receive a pension equal to 95% of a normal retirement pension, resulting in substantial pension increases for all affected retirees and alternate payees.
Class Notice - This is the notice to affected class members that has been approved by the Court, it provides a summary of the settlement and contains information about your legal rights if you are a class member.
Proposed Settlement - This is the proposed settlement of this matter. It contains detailed information about the settlement and has been granted preliminary approval by the Court. It will be considered for final approval at the fairness hearing, which will take place on November 15, 2024 at 9:00 A.M. in Courtroom 7 on the 19th floor of the United States District Court for the Northern District of California, 450 Golden Gate Avenue, San Francisco, California.
Class List / Appendix B - This is the list of persons who are in the settlement class whose rights will be affected by the settlement, also attached as Appendix B to the proposed settlement.
Preliminary Approval Order - This is the order of the Court preliminarily approving the proposed settlement, certifying the settlement class, and setting other deadlines applicable to the final approval process.
Complaint - This is the document that initiated the lawsuit, it contains a short and plain statement of of the underlying factual allegations and legal theories in the lawsuit.
Motion for Preliminary Approval - This is a motion filed by the plaintiff requesting preliminary approval of the settlement, it contains a description of the case and the proposed settlement, details about how the settlement was reached, information about our firm, and legal arguments and authorities regarding why the proposed settlement should be approved.
Motion for Attorney’s Fees, Costs, and Case Contribution Payment - This is a motion filed by the plaintiff requesting an award of attorney’s fees, costs, and a case contribution payment. If approved, these funds will be paid by the settling parties separately from the amounts being paid to the Plan’s trust fund and the enhanced pension payments and will not in any way reduce the recovery to class members. This packet contains both the motion itself, the memorandum of points and authorities submitted with that motion, and the declarations and other supporting documents submitted in support of the motion.
